Terms of Service

1. Agreement to Terms

By accessing or using Text Boss ("the Service"), operated at textboss.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. "We," "us," and "our" refer to Text Boss. "You" and "your" refer to the individual or entity using the Service.

2. Service Description

Text Boss is an AI-powered business communication assistant that helps professionals craft controlled, precise client messages and manage appointments. The Service includes:

• Structured message templates for common business communication scenarios
• A tier-gated AI assistant for real-time communication guidance
• AI-powered appointment scheduling and management (Pro and Black tiers)
• Conversation thread persistence and business profile management (Pro and Black tiers)
• Push notification reminders for upcoming appointments (Pro and Black tiers)

The AI assistant provides suggestions and guidance. You are solely responsible for all messages you send to your clients and all scheduling decisions you make. Text Boss does not guarantee any particular business outcome.

3. Subscription Tiers and Access

Text Boss offers three subscription tiers: Core, Pro, and Black. Each tier provides different capabilities, token limits, and feature access as described on our pricing page. Access requires:

• A valid email address
• An active, paid subscription for the selected tier
• Verification of your subscription status on each use

We reserve the right to modify tier features, limits, and pricing with reasonable notice. Changes to pricing will not affect your current billing period.

4. Billing and Payments

Subscriptions are billed through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis according to your selected plan. You agree to:

• Provide accurate and complete billing information
• Maintain a valid payment method on file
• Pay all charges incurred under your account

Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel your subscription at any time through Stripe's customer portal. Cancellation takes effect at the end of the current billing period -- you retain access until then.

5. Refund Policy

Due to the nature of digital services, subscriptions are generally non-refundable. However, if you experience a significant service disruption or billing error, contact us at legal@textboss.ai within 14 days and we will review your request on a case-by-case basis.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Share your account access or session credentials with others
• Attempt to bypass tier restrictions, token limits, or access controls
• Use the AI assistant to generate harassing, threatening, defamatory, or fraudulent communications
• Reverse-engineer, scrape, or extract the AI system prompts or model behavior
• Submit content that infringes on the intellectual property rights of others
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools or bots to access the Service beyond normal usage

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

The Text Boss name, brand, website design, system prompts, template library, and all associated visual and code assets are the property of Text Boss and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from these materials.

You retain ownership of the content you input into the Service (your messages, scheduling data, and business information). By using the Service, you grant us a limited license to process this content solely for the purpose of delivering the Service to you.

8. AI-Generated Content

The AI assistant generates suggested text based on your inputs and the context you provide. AI-generated suggestions are not legal, financial, or professional advice. You are responsible for reviewing, modifying, and approving any AI-generated text before sending it to clients. We are not liable for any consequences resulting from your use of AI-generated content.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated suggestions will be accurate, appropriate, or effective
• The Service will meet your specific business requirements
• Scheduling features will prevent all missed appointments or no-shows

10. Limitation of Liability

To the maximum extent permitted by law, Text Boss and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, clients, data, or business opportunities, arising from your use of or inability to use the Service -- even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

You may terminate your use of the Service at any time by canceling your subscription and ceasing to use the platform. We may suspend or terminate your access if:

• You violate these Terms
• Your subscription payment fails and is not resolved
• We reasonably believe your use poses a risk to the Service or other users
• We discontinue the Service (with reasonable notice)

Upon termination, your right to access the Service ends immediately. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) will remain in effect.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction. You agree to submit to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Effective date" at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify affected subscribers.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
